The Montroy Series: The Intersection of State and Federal Criminal Law

Mark Ackley, First Assistant for the Federal Defender Services of Idaho

Individuals charged in state court often face the unpleasant prospect of a federal indictment.  What can the defense lawyer do to best protect their clients in such circumstances?  It starts with an understanding of how the state and federal systems overlap.  During the Zoom meeting, Mark Ackley will provide an overview of the intersection of the state and federal regimes with a focus on sentencing issues, including mandatory minimums, the impact of prior convictions and sentences, concurrent and consecutive sentencing, and immigration consequences.  The meeting will also address various strategies for state practitioners with clients facing federal charges. He joined the Federal Defender Services of Idaho in 2010 where he handles trials once again and serves as First Assistant.
