Idaho Code Title 19, Chapter 8, Criminal Procedure, Examination of Case and Discharge or Commitment of Accused, contains key provisions regarding the rights of indigent persons and the obligations of Idaho indigent defense providers, including counties and attorneys, in representing indigent persons. This chapter also contains the powers and duties of the Idaho State Public Defense Commission. Sections 19-848 through 19-866 are known as the Idaho Public Defense Act. We encourage all indigent defense providers to regularly review Title 19, Chapter 8 and ensure they understand these laws, and reach out to their supervising individual or entity or the PDC with any questions.
